DraftKings and FanDuel can operate in New York again

Last month we brought you the news that the Supreme Court ruled that both DraftKings and FanDuel could no longer operate in the state of New York. Well, specifically, that they were barred from "accepting entry fees, wagers or bets from New York consumers in regards to any competition, game or contest." That pretty much takes all of the fun out of what those companies do. It looks like that ruling is changing, at least for now.

According to a DraftKings attorney, both DraftKings and FanDuel will be allowed to operate, at least for the time being. The companies are currently seeking an appeal to the decision, and have been granted a permanent stay, allowing them to resume conducting business with New Yorkers throughout the appeals process.

Both sites have asserted that their fantasy games are not gambling, but rather are games of skill. If they're able to prove this to the court, they would be able to continue operating permanently.

Of course, New York isn't the only state that both sites are fighting to operate in. There are currently 6 other states that they cannot operate. If they're able to make their case in New York, it's possible that they may be able to persuade some of the others to change their stance, as well.
