Lindsay Lohan Suit Over GTA V Beefed Up By Legal Team

Lindsay Lohan is one of those celebrities that are better known for self-imploding than for her acting these days. One of the things that gamers might know her for is her legal campaign against Take-Two Interactive over what she claims is her likeness used in promotional materials for the game without her consent. The original legal complaint was a 10-page offering and her legal team has now beefed up that complaint by filing a new 67 page document with courts.

The name of the character that Lohan takes issue with is Lacey Jonas. In the game, Jonas is an actress that the player has to help escape paparazzi in one of the many side missions. Take-Two had asked courts to dismiss the suit claiming it has no legal merit and was field solely for publicity purposes.

Lohan's legal team filed the new document complete with 45 pages of pictures of Lohan and images of game discs. The Lohan team claims that Take-Two used a look alike actress to "evoke the persona and image" of Lohan. I always thought the blonde in the game looked more like Kate Upton.

Lohan's legal team says that the game publisher used the image of the blonde character on shirts, coffee mugs, billboards, posters, buses, and websites. The team also claims that the use of the likeness of Lohan doesn't fall under transformative fair use that would be protected by the first amendment.
