Apple loses sales ban attempt against tweaked Galaxy Tab 10.1N

Apple's attempts to ban Samsung's redesigned Galaxy Tab 10.1N in Germany, along with the Galaxy Nexus, have failed, with the courts ruling that Apple's touchscreen patent was likely to be revoked in short order. "Samsung has shown that it is more likely than not that the patent will be revoked because of a technology that was already on the market before the intellectual property had been filed for protection," Judge Andreas Mueller told the Munich Regional Court today, Bloomberg reports. Apple's bid to have sales of the Samsung Galaxy Tab 10.1 blocked in the Netherlands has failed today, with a Dutch appeals court dismissing Apple's claims of IP infringement by the Android tablet. The ruling - released in Dutch - found that while Apple's tablet design patent 000181607 is still valid, prior art including HP Compaq's tc1000 and the 1994 Knight Ridder concept meant the Cupertino company's design rights are very narrow. Apple has had its complaints about the redesigned Samsung Galaxy Tab 10.1N rejected in German courts today, with the judge deciding the tweaked slate differs enough from the iPad aesthetic. "According to the court's assessment, the defendant has moved away sufficiently from the legally protected design," Judge Johanna Brueckner-Hofmann told the court today, Reuters reports, with a full ruling expected on February 9 2012. Samsung has officially confirmed the Ice Cream Sandwich upgrade schedule for its current line-up of smartphones and tablets, promising that the Galaxy S II and Galaxy Note will see Android 4.0 in Q1 2012. Eight devices are listed as in line for upgrades, including the Galaxy S II LTE and Galaxy R smartphones and the Galaxy Tab 10.1, Galaxy Tab 8.9, Galaxy Tab 7.7 and the Galaxy Tab 7.0 Plus. This week as the Samsung 10.1-inch tablet reaches stores after having been banned for weeks in an Apple injunction to do away with sales altogether, Samsung Australia mobile chief Tyler McGee noted that far from destroying sales, Apple has instead made their Android-based slate a "household name." A Sydney court lifted the Galaxy Tab sales ban after an appeal by Apple was denied, this ending a two-month out of store stint while the law made its decision on whether or not it thought Samsung infringed on Apple's iPad product. What McGee is saying now, though he wont reveal any numbers thus far, is that the Apple case and the media coverage it generated will without a doubt provide a boost in sales once they've got their product back in stores.
