US Patent bill passed but critics say it’s relapse not reform

A controversial patent reform bill has been approved by the United States Senate, prioritizing those first to file for a patent rather than the first to invent the technology, and is expected to be signed by President Obama imminently. The America Invents Act not only amends the process for filing patents but the system for challenging them, with the introduction of a post-grant review that, it’s argued, will allow bad patents to be re-examined. The bill’s supporters claim it will streamline the filing process, allow the USPTO to more quickly crunch through the huge backlog of existing applications, and bring the patent system overall more in line with what other countries operate. Its critics, however, claim progressive amendments to the bill have diluted it to the point where it can no longer be considered true reform.

Apple injunction against Galaxy Tab 10.1 upheld in Germany

Apple has re-secured its injunction against the Samsung Galaxy Tab 10.1 in Germany, with the Düsseldorf courts upholding its existing ban on sales. In what was reportedly a short sitting this morning, NetbookNews reports, the judge deemed that Samsung’s “smooth, simple surfaces” of the 10.1-inch Honeycomb tablet copied the minimalist aesthetic of the iPad, a design that Apple secured back in 2004.

Acer and ViewSonic agree to Microsoft patent licensing deal

Acer and ViewSonic are the latest companies to cough up their Microsoft tax, agreeing to pay the company in return for the freedom to use technologies the Windows maker has patented. Acer's agreement covers its Android devices, while ViewSonic's covers both Android and Chrome OS; we're presuming this means the company is still considering putting the Google platform on dual-boot tablets, as first suggested back at the ViewPad 100 launch. HTC bought Google patents for indefatigable Apple fight

HTC has confirmed that it bought the Google patents it is using in its latest legal blast against Apple, describing the litigation as "an obligation" to its business, partners and customers. The company refused to tell AllThingsD exactly how much it had spent on the patents - and Google would only confirm that they had been transferred over the past two week period - but, in a statement given to SlashGear, HTC argued that it would keep returning to the courts until Apple's infringement stopped. Oracle vs Google Android lawsuit headed to settlement talks

In one of the most important law-related situations in Google’s mobile OS Android’s relatively short history, Google and Oracle appear to be heading to a settlement agreement over whether Android does indeed infringe upon Java code owned by the other party. In a case we’ve been covering since its inception in over a year ago in August of 2010, Google’s original claim that this is a “baseless lawsuit” appears to still be their position, Eric Schmidt’s July 2011 comments still ringing true, yet both Oracle and Google have agreed to a court-suggested mediation between the two parties.

RIM must monetize patents or sell up investors demand

RIM is facing pressure to spin off its patents, with investors demanding that the Canadian company either consider monetizing its IP or give serious consideration to selling itself. The proposals have been spawned by Jaguar Financial Corp., which told SFGate that RIM's sole focus on its incoming QNX product line-up amounts to putting "all your eggs in one basket" and leaves the firm facing potential bankruptcy in the manner of Nortel Networks. Samsung Galaxy Tab 10.1 Australian launch further delayed under Apple assault

Samsung’s concessions to the ongoing Apple legal onslaught continue, with news that the company has agreed to put Australian launch plans for the Galaxy Tab 10.1 on ice until September 30. The agreement – which comes despite Samsung’s earlier protestations that it had a separate version of the 10-inch tablet for Australia, that did not infringe any Apple technology – will see Apple detail the patents it alleges its Korean foe has overstepped by September 5, the Sydney Morning Herald reports, with Samsung responding by September 16. Until the end of the month, however, Samsung has acquiesced to neither selling nor even advertising the Galaxy Tab 10.1 in the country.

Apple wins against Samsung for expedited trial date in California

Patent bill doesn’t provide meaningful alternatives to litigation

It's not hard to see that the patent system in the US needs a major overhaul. Patents have been issued that are so obvious and wide reaching that it seems anything made today violates one patent or another. The Senate is set to start working on a bill in early September to reform the patent system. Sadly, Reuters reports that the bill does very little to actually reform the patent process. Apple patent app reveals advanced “Maps + Compass” feature with augmented reality

A new Apple patent application has surfaced today, revealing that the company has some interesting plans ahead for its "Map + Compass" iOS feature.
