Apple’s “clearly wrong” Aussie Samsung tablet ban overturned

Apple’s “clearly wrong” Aussie Samsung tablet ban overturned

Apple's sales injunction against the Samsung Galaxy Tab 10.1 in Australia has been overthrown, with an appeals court dismissing the original block as "clearly wrong" and allowing the Android slate to go on sale this Friday. The Cupertino company secured a short stay until the end of the week so that it could ready an appeal of its own, but was told by the Sydney court that if it wanted to extend the tablet ban - handed down in October when Apple convinced a judge that Samsung had "slavishly copied" its iPad design - it would need to convince the High Court.

Apple has tablet “monopoly” says judge as Samsung appeals ban

Apple has tablet “monopoly” says judge as Samsung appeals ban

Samsung has accused an Australian judge of "fundamental errors" and of misunderstanding the law, as the company protests its recent legal failures against Apple. Challenging the Galaxy Tab 10.1 sales ban awarded last month in the appeals court this week, Samsung described the original ruling as being "grossly unjust" SMH reports, and arguing that Justice Bennett "misunderstood and misapplied the basic requirements" around deciding whether Apple's patents were in fact valid.

Apple demand for broad Samsung tablet ban rejected

Apple demand for broad Samsung tablet ban rejected

An Australian judge has rejected Apple's attempt to have Samsung forced to give the Cupertino company advance notice of new product launches, as well as have limitations placed on tablets other than the Galaxy Tab 10.1. Speaking of yesterday's preliminary sales injunction ruling, Justice Annabelle Bennett told Apple that "it doesn't apply to any other player in the marketplace," WSJ reports, dismissing requests to extend the decision to future models Samsung might release.

Apple wins Samsung tablet sales ban in Australia

Apple wins Samsung tablet sales ban in Australia

Apple has won a preliminary sales injunction against Samsung in Australia, blocking the Galaxy Tab 10.1 from hitting store shelves and leaving the Korean company to face either a 2012 trial or scrapping the slate altogether. The federal court judge decided in favor of Apple's claims that Samsung infringed on two patents the company holds, SMH reports, concluding "there were several factors that favoured Apple."

Target Android tablet selection lifted above Apple’s iPad 2

Target Android tablet selection lifted above Apple’s iPad 2

This week Target will be evolving their mobile selection in several places, most notably in the tablet department, where Android tablets will be much closer to the smartphone selection than the iPad 2. For those of you that follow my analytics of the Target department store chain (whose home is right here in sunny Minnesota), you know that I've had more than one conniption fit over both the placement of Android tablets and the arrangement of their entire mobile section in general. Just this morning while picking up some random oddities, I noticed that big red may well have heard my siren call: the Android tablets are now less than 10 feet away from the smartphones.

Apple refuses Samsung settlement in Australian tablet case

Apple refuses Samsung settlement in Australian tablet case

Apple has rejected Samsung's mysterious settlement offer as the Korean company attempted to get its Galaxy Tab 10.1 on sale in Australia, with the two firms described as "a considerable distance apart." Samsung maintains that Apple has denied any settlement, the WSJ's liveblog from the Australian court reports, while Apple argues that the barrage of concerns it had apparently fired back "were requests for details, not a rejection of the offer."

Apple seeking EU ban on ALL Samsung Galaxy smartphones, tablets

Apple seeking EU ban on ALL Samsung Galaxy smartphones, tablets

Following Apple's recent win in blocking Samsung Galaxy Tab 10.1 sales in Germany, the company is now filing a more extensive complaint in the Netherlands to ban the distribution of all Samsung Galaxy branded smartphones and tablets in Europe. Unlike the previous filing, however, this one calls for not only a ban on upcoming products but also a recall of existing stock from resellers.

Apple targets Motorola XOOM next in Euro tablet cull

Apple targets Motorola XOOM next in Euro tablet cull

Details of the Apple preliminary injunction against Samsung's Galaxy Tab 10.1 have revealed that the Cupertino company is also targeting the Motorola XOOM in Europe, with a complaint already filed over the design of the Honeycomb slate. Although there's no confirmation that Apple is seeking a similar injunction against Motorola for European XOOM sales, FOSSPatents points to a third, local German tablet company, JAY-tech, which is also named in the paperwork and which has already been banned from selling its wares.
