Samsung did agree to license them under FRAND however, apple is the one that has rejected the licensing terms--saying 1) they don't need a license, 2) the patent is invalid, and 3) they already have a FRAND license via France with Samsung. Actually, hilarious when you read apple's lawyers discuss this.

What's a joke is that the German legal system continues to base their analysis on Apple's community design instead of evaluating whether the community design is even valid in the first place. Of course Apple would be correct if you assume their community design is valid, but that's not the issue. What a bunch of amateur judges.

Germany is a joke and a sham. Apple is the REAL anti-competitive company here.

The law is so corrupted up that only by technicality, not rightfulness, is Samsung being investigated, while Apple, being morally wrong by pushing ridiculous lawsuits, could be legally correct. Another example of where the law protects the wrongdoer and punishes the one who is trying to defend themselves.

Germany judges must be embarrassed at their lack of intelligence.

Samsung agreed to license these patents on FRAND terms, if they didn't then they should be fined. If these rules weren't in place Samsung could extort pretty much any company needing to use industry standards like 3G. Its a completely separate issue from Apple's trade dress suits.

If a competitor is suing you for all sorts of things and doesn't act in good faith to try to reach an agreement amicably (from the news Samsung noted they would like to work things out and from Apple, Steve Jobs noted he is going thermonuclear against handset makers of Android) then why can't Samsung use that as leverage to get Apple to come to the bargaining table?

It makes no sense. If you own something that is extremely valuable then you're under the scrutiny of the government to bed with your enemy yet if you own a patent for something trivial then you can use that to block a competitor's product.

Great to know that the tag can wag the dog.
