Samsung just needs to show it had plans for a similarly designed TABLET before ANY public announcement of iPad. I am sure Samsung was already investing millions in it, just as Apple was.
I am sure here are other manufacturers who had tablet development plans with a mobile OS in the making before Apple sprung it on he public in 2010. Apple simply had industrial spies looking at designs that predate the first iPhone with a single home button and proprietary 30pin connector.

Should be a lock for Samsung. Documentation doesn't lie.

Much has been said about copying in this case, but what about timing and detail?

The design registration document Apple sited in the original German case was very vague. Probably written when their tablet concept was just a sketch with a notional specification attached. Did the name "iPad" even exist at that time? So why was this vague, catch all, document accepted - then or now - as the basis for such an important legal judgement?

This dispute is deeply misguided. Two huge companies, each with substantial merit and achievements; plus a well established business relationship - kicking hell out of each other instead of negotiating a solution.

German courts should be slapped in the face, for f***ing up the whole union with presumption of validity. OHIM/OAMI does not validate or review these Community Design registrations for novelty.

I hope they filed for invalidity in the Netherlands, where the CD will be struck down rather fast...
