Unless someone uses a smartPhone for uses that Vivid Entertainment would be using[Phones have a vibrating function], I don’t see where the confusion claim stems from.

I think that Vivid entertainment should stand up for themselves and show some spunk. Fortunately the HTC Vivid is not 3D enabled or we might really see a messy courtroom drama; it would give whole new meaning to coming at you in 3D

The only people who might confuse a smartphone with a pornographic video are currently considering SOPA in the US Congress. When you’re old, technologically illiterate, and essentially operated entirely by bribes (now called “corporate campaign donations”), you find it easy to confuse things in favor of whoever paid you the most.
