Well Post 911 Legally speaking... The Homeland Security Act and the "Measures" that were tabled into existinse are ways and means of getting around the sticky issues of due process, privacy , and pretty much all citizens rights when the "nation s' security is at risk". And the mass of American citizenry was so embroiled in fear & mourning that it passed with a nationwide Hurrah!

Very high potential for retribution against the wrong party. The internet is a lot closer to being anonymous (and vulnerable to being spoofed) than is a physical attack. Besides, individuals can far more easily launch attacks in cyberspace, and then claim (or have it be assumed) that they were acting with the support of a state.

I don't have a solution to propose. But "a missile down the smokestack" is not it, and this will not end well.

What are you going to have them do? Drop a bomb on a residential household or maybe in your neighborhood cause your neighbor kid hacked the government? We already have laws and extradition if its foreign. You still have to find the attacker, and when found global police forces and international law usually take care of setting up a trial. Or is that what is at stake here? And if you are going to physically harm the attacker, you had better be absolutely certain they are the real attacker, and not perhaps your home computer, that the attacker used to preform the attack. Better hope the pentagon does its homework before bombing your family and calling it a day. I mean someone paid for it right?

And how can you even talk about morals and killing the family of a criminal in the same sentence? =) The future leaders of humanity do need good role models growing up, but the loudest voices, those of corporate greed, government dominance, corrupt banks, and manufactured scarcity and suffering are not leading us in the best direction.

AND if you do your homework its not like our own government hasn't personally declared themselves above all law, they do more illegal hacking in the name of "the american WAY OF LIFE" and "national (financial) security" than they are victims of successful hacking.

First it was weapons of mass destruction which we never found, now its cyber attacks we can't even verify. A complete GHOST "terrorist". Probably not a good thing since we have enough historical proof of how our government operates.

You know the real terrorists are the ones spreading the fear and terror. Who's voice do you hear the most?

And....maybe the pentagon should quit running windows....just saying

I agree 100% in what you are saying. How do we deal with the individuals who look the other way when there is a large cost over ride in building a military jet, how do we stop the people who we elect to office from taking money under the table ( of course non would do that ) how do we stop them from kick backs. How many people do you think believe and trust in the congress, state senator's, or any other elected member of state, local or federal government. How would you feel if one of your family members made a mistake and got involved with other to hack into the government sites. Would you feel the same?

This also means that, anyone doing anything to attack a US company, US citizen, US installation, etc online regardless of country of origin will be actually breaching that area of operation, and then the army will be rushing over to that place with just cause for a cyber attack...

so those bot-net sources that start up internationally, that'll be really fun!

I agree though, this is a good idea, and besides, will get the fellows as Lulzsec something to do if the DOD hires them to track down other hackers... hehe.

The Coast Guard would be the branch of choice, only problem would be if any cyber attack took place in central or north west part of the US. With the 3ID ( know them well from many reforges) they would be the one of the first to be called in to assist the local FBI, or what ever agency get's there first, then Coast Guard starts to update its patrols of all water ways into the area from where the attacks started from. Now, if a cyber attack were to start, i do not think that they would just use one location, but would have a number of sites set up to attack at the same time, or at different times thru out the day. Now comes the part, who has the largest group of individuals to handle several different location within the US. Here comes your Delta force, Navy Special Operations and so on. FBI might want the operation control center as their HQ (headquarters) for the duration of cyber attacks. Everything you stated I believe you are correct, except who has the Big Bucks to spend, even though they are talking about cutbacks in the military budget, and who has the biggest ego. Problem is no matter who takes control, does anyone think that we can stop all cyber attacks? How many cyber attacks have been made in the past year, and how many individuals have been caught?

would be if any cyber attack took place in central or north west part of
the US. With the 3ID ( know them well from many reforges) they would be
the one of the first to be called in to assist the local FBI, or what
ever agency get's there first, then Coast Guard starts to update its
patrols of all water ways into the area from where the attacks started
from. Now, if a cyber attack were to start, i do not think that they
would just use one location, but would have a number of sites set up to
attack at the same time, or at different times thru out the day. Now
comes the part, who has the largest group of individuals to handle
several different location within the US. Here comes your Delta force,
Navy Special Operations and so on. FBI might want the operation control
center as their HQ (headquarters) for the duration of cyber attacks.
Everything you stated I believe you are correct, except who has the Big
Bucks to spend, even though they are talking about cutbacks in the
military budget, and who has the biggest ego. Problem is no matter who
takes control, does anyone think that we can stop all cyber attacks? How
many cyber attacks have been made in the past year, and how many
individuals have been caught?

now those are good points. They would have to step aside and let the FBI take the lead....technically. The problem is that ever since Hurricane Katrina the Federal government (both parties mind you) seem to have a more relaxed stance on p.c. For example the is a B.C.T.(Brigade Combat Team) from the 3rd I.D. (one of my old units coincidentally) has been given over to NORTHCOM to be "called upon to help with civil unrest and crowd control or to deal
with potentially horrific scenarios such as massive poisoning and chaos
in response to a chemical, biological, radiological, nuclear or
high-yield explosive (CBRNE) attack." So with cyber being an operational domain...slippery slope my friend. Of course they could always use the Coast Guard who is a military force that is not a part of the DOD. (They were DOT then got farmed out to DHS.

well legally speaking any attack emanating from the sovereign territory of the United States would be the domain of the FBI and not the military as that would be a violation of Posse Comitatus.

You know it's nice to see the government make a good decision for a change. I'd be disappointed if they hadn't effectively done this long ago and this is just the declaration of "Open Season".

This opens lots of interesting scenarios. For instance, Country X hires mercenary hacker group to disrupt something cyber-important. US dispatches bad-a** American squad to take out merc hacker group *AND* puts high explosives up Country X smokestacks.

Cool. It deals with the problem and makes merc hacker groups think twice about state-sponsored terrorism.

Of course the USA version of state-sponsored terrorism will continue. I'm talking about where the banks, bond funds and other big-money-powers loot the economy with bubbles, front-running, HFT, bailouts and the revolving door that is Washington DC.

"The two most common elements in the universe are hydrogen and stupidity. But not in that order."

Wonder what they would do if the cyber attacks leads them say to a large building in New York, or maybe Saint Louis or even from down town Washington DC. How are they going to drop something down a smoke stack in one of these cities.
