The only fees covered under FRAND guidelines are rates going forward after they settle. Apple has been infringing some of Moto, Samsung and Nokia’s Standards based patents since iPhone was first launched. So Apple has accumulated long neglected back payment interest and penalties that are not covered under FRAND rules lumping everything on to future sales to make it look bad!

In reality, no patent license fee alone is more than 2 to 4% of the affected chip cost. NOT….. it’s device’s retail market value like Apple is claiming!!!

For taking sides, and filling the comments section with your own flavor of anti-Android (by your vast experience with ONE Samsung Infuse), I think that you have very little to add. Read the article, you might have missed that it is about Apple and Motorola’s hardware 3G patents. Specifically, this patent dispute has nothing to do with what OS you prefer. I apologize for not being more clear with you before.

Damn right. Apple has the profit from selling the device at a premium, taking a cut of app sales, music, movies, books. You can switch easy from a Samsung device to HTC to Moto or LG and keep any app you bought. Apple designed a monopoly so prices should rise accordingly.

When Apple cross licenses iOS then they’ll be eligible to equal terms.

However the case may be more complex. Remember that a certain OS user is a lot more likely to stick with the platform( if he bought any apps), and iOS is Apple’s private playground. Apple has all the profit and control of anything iOS which put’s them in a different basket.

So there is definitely grounds for making it easier and cheaper for other Android vendors, if you take Apple’s iOS complete monopoly into account, and the fact they alone profit from it at the expense of all others( Android market competes with amazon and others ).And I don’t think Cydia counts here.

Is this a valid legal argument? No idea. That’s for the judge to decide. But likely Apple’s legal team will win without paying a dime while others have their products banned for sale for using swipe to unlock or something.

My claim is that Forbes article is a classic example of trolling. The title is misleading, making users think that iOS is less stable than Android then they go on explaining how more Apps(not the OS) crash slightly more on iOS which like I said does not say much about the stability of iOS but the Apps designed by not so careful developers.

The sample used on the survey is also questionable but I dont care so much about that. The article on forbes says absolutely nothing about iOS or Android crashes. If you cant see that, you are just another laughable fandroid who gets carried away by poor studies and misleading titles.

And Motorola almost undoubtedly made the offer thinking that Apple would make a counter offer. Motorola probably wanted 5-7 dollars a phone, and asking a high price when initiating barginning is just plain intellegence. Anyone who think that this is the whole story is deluding themselves. What Apple did is like stealing a car because the car dealer is asking 40,000 on a 25,000 car.

Apple is not the only company Qualcomm sells their chips to, however Motorola wanted Apple to be the only company excluded from the agreement. No matter how you want to look at it, this is a case of discrimination. This move is the way they have to actually bring Apple to court and nothing else. Apple wont be able to claim exhaustion of these patents but at least they can raise a FRAND defense.

your analogy is very wrong. you don’t seem to understand what happened at all. you should read my post again and the comments I address to.

Moto does not care if the product is cross-licensing from Qualcomm. It’s Apple who uses the technologies without consulting Moto who has a take in this matter. Moto can charge whatever it wants whether Apple like it or not. There is a law called “Price Fixing” but there isn’t one that dismiss anyone from going beyond the price/percentage. It’s like overpaying for your iProducts that shouldn’t cost that much to start with.

so did Qualcomm have a commercial licence agreement to resell moto’s IP to other commercial 3rd party vendor’s such as apple, NO

you as a non commercial end user seem to have the wrong idea about the “Fair Reasonable and Non Discriminatory” licensing guidance, all commercial vendors that commercially use the originators “IP for profit” Must licence it from the originator/owner of the IP or an authorised re-licensing party, if not, that can be considered “commercial piracy”

moto is not saying they or anyone else cant licence this IP, only that apple make and sign a legally binding purchase for that IP from the commercial owner, I.e Motorola themselves, that’s fair.

and OC less you forget , its the actual Non commercial end user that finally pays the FRAND and other costs anyway as these and the actual profit are always included in the final recommended retail price

I don’t understand why would Apple complain about Samsung copying them when Steve Jobs said: “Good artists copy great artists steal”. Also it’s pretty known fact that most of the original concepts Apple stole from other companies such as Xerox.
