I’d suspect that Australia is based on common law and Germany is based on civil law. In civil law things are a lot more clear cut, with less wiggle room for argument that you have in common law which allows referring to case law.

And if Apple refuses to provide stats, and Samsung makes a good case.. I’m not sure if it’s on the balance of probabilities or some other standard in Australia … then Apple has to pay Samsung for lost sales, in which case they can refer to their sales stats elsewhere to extrapolate what they might have sold, and Apple has to pay them that. Would be kick ass if Apple has to take out advertising to the effect that the Galaxy Tab was not infringing on Apple patents. They’d probably argue against that in some fashion, but I’m sure that Samsung’s lost marketshare would have additional value that Apple would have to compensate them for.

This judge wants objective evidence to show that people are confusing the two, or to show some other tangible detrimental effect–which is the sensible route to take instead of getting caught up in Apple’s cry-baby, baseless assertions.

Where’s the harm?! They haven’t been able to show it anywhere, either through manipulated comparison images or childish assertions. Their sales are astronomical.

Why before Apple we had PDAs, Pocket PCs, PalmPCs, Webpads etc and after Apple copied Crunchpad/JooJoo tablet nobody else may offer products to this market segment and compete?We have mobile telecom companies offering the same product (telephone calls, sms, data traffic) on different prices and packages and offering different coverage and quality. Let’s then have only one mobile telecom company with exclusive rights on the mobile telecom market everywhere in the world!

I would be an idiot to ever pay full retail prîces at places like Walmart or Bestbuy. I sold a 37″ HDTV to my boss for $600 that I only paid $78.24 for.

That doesn’t make any sense.  There has to be more to this story or something is “getting lost in translation.” Of course sales of a competing product are going to effect sales.  How would lower iPad sales (which I don’t think there are) show anything other than lower iPad sales?  For that matter since when was apple gauranteed iPad sales?  Why does it matter if someone “wants an android tablet” or walks into a store and after comaring apple and android walks away with the android tablet?
