big problem, as i see it, is that Apple, Microsoft and others are
filing patents for the most trivial and obvious technical mods instead
of groundbreaking inventive steps in order to frustrate the
competition. Did you know that Microsoft patented the &#039;double-click&#039;? Yes, the double click of your mouse button to trigger a process
distinct from the single click. What a f***ing breakthrough that was!
And it&#039;s all possible because the US can no longer compete in the area
of mass manufacturing of consumer products (now outsourced to their
Asian friends), the flim-flammery of legal argument and the extremely
high costs of litigation. A simple first step solution is to deny
patents to software, then enforce the inventive step requirements of the intellectual property laws that have been roundly ignored.

		<description><![CDATA[One problem is that patents last too long.  Granting 14 years of exclusive rights in our rapidly changing economy no longer makes sense.  Innovation will come to a standstill if these laws are enforced.   We must also realize that all ideas evolve rather than occur in a vacuum.  Every idea comes as a result of past knowledge that makes new ideas possible.   Our patent system needs to allow inventors to benefit from their ideas, but not at the expense of ongoing knowledge or freedom for others to create and compete in a free market system. ]]></description>

Otherwise, what HTC said IS true! Lately, Apple has been falling behind in the mobile phone business. The iPhone has been losing market share left and right (http://reviews.cnet.com/8301-19736_7-20068677-251.html) and feature-wise Android has been accelerating. Apple still does have it&#039;s absolutely masterful techniques of implementation, but that doesn&#039;t seem to be enough lately (and in my opinion, it simply isn&#039;t enough).

Just think about it. How many lawsuits against some of the biggest handset manufacturers has Apple filed in the last 2 MONTHS? I can think of quite a few. It&#039;s a big list. It&#039;s like they&#039;re trying to tear apart the mobile market so they can try to jump back in. It&#039;s disgraceful!

Sure, they have to &#039;protect&#039; their &#039;intellectual property&#039;. But this is just getting to be pathetic. What bugs me most is that they might actually win these cases if the courts back them; the founding principles of their case(s) are so terrible, and I&#039;d hate to see HTC lose out here.]]></description>

Do you have any idea what these patents are for, just go and read them Slashgear has even added links to the patents.Why HTC is talking about competing in court rather than market place is because they just copied and wouldn&#039;t be able to stand in the court and say that they invented. The worst part is HTC is not just copying software IP, they have started copying manufacturing process also for companies like Apple and Sony. And that&#039;s why Apple is becoming this aggressive. Like the Aluminum Unibody design that Apple developed in 2006 and HTC simply copied it. HTC is even calling is Unibody design. Development of manufacturing process can cost millions of dollars, but copying can be done very cheaply. Its UI was just like BlackBerry and every demo unit that Google showed before 2007 had a keyboard there was no talk about touch. After iPhone was launched in 2007 that completely changed suddenly the UI was all about touch, in fact Google had to delay Android launch by almost one and half year just to copy the touch UI. ]]></description>

Patents that have been granted often merley describe the problem in detail not a particularly innovative solution to it. EG a scroll bar is needed in a situation where you have content larger than the window, THe scrollbar simply is an analytical truth of the problem and is NOT an innovation. It would be like patenting the 3 button mouse ... oh hang on that happened. It is not in anyones advantage. 

All your post really says is big corporations want to make money and we should  legislate at all cost to allow this.

Its like the patent on multitouch technology ... they dont own that ... but some douche bag allowed a patent on using multiple fingers to zoom ... again an analytic truth of zooming is that you have to express a vector and  so multi touch zoom is not an innovation. If they had written some cool algorithm to implement it then THAT should be patented.

you do realise that the software you are using is layer upon layer upon layer of other peoples work. If everyone started to act like apple EVERYONE would be suing and the industry would be unable to make anything at all. I think you are bringing assumptions from a different problem domain into this conversation.]]></description>

IOS5 is like a giant reskinned android UI over the top of IOS4. 

The bottom line is apple patients the most ridiculous shit in the hopes that some day someone will actually make it work....so apple can then sue them. 

They cant compete with android in the marketplace so they just buy patient portfolio&#039;s and sues the crap out of the people that produce the handset.
