They could commision other firm to produce tablet and just put on this their sign. Damn, you realy cant resolve problems - typical pessimist :). And truly, if it was be Apple instead of Hasbro, verdict of the judgement could be different. My question was rhetorical - i didnt expect the answer.

It's pitiful and readily apparent what Asus going for, not to mention unfortunate that they were too stupid and shady to go for the obvious tie-in, but not illegal.

Your retort is baseless, Hasbro makes toys and Asus makes CPU/Electrical devices. Hasbro has had 30+ years to do something like that but their product only speaks to children. Did you rush out to buy a $30,000 car when they teamed with Michael Bey and General Motors to use their line of cars for the live action movie? :-o. To answer you curious question of what Asus would say.... Nothing!!! Unless Hasbro called it the Asus Eee Pad Transformer Optimus Prime.

Sorry but the judge is right, it was a long shot at best for Hasbro to win that case.

For one thing the actual Hasbro franchise is for "Transformers" as in the plural with a "s" at the end and never for the singular.

Second, the judge was right that Asus use of the term wasn't just a gimmick or attempt to capitalize on the Hasbro franchise, which would have been the only reason why there would have been any legal reason to decide in Hasbro's favor.

Third, Hasbro's copyrights are for entertainment media and not physical products that have nothing to do with their franchise. Even their latest cartoon series of "Transformers Prime" did not meet even the reasonable expectation of confusion with an obviously different product.

The Asus product is the Transformer, in the singular, Prime. Hasbro has no copyright over standard language words which both Transformer and Prime are! So it's rather obvious why the judge had to decide against Hasbro on this one.

Rather than suing, Hasbro should have negotiated a deal with Asus to produce a Transformer themed Transformer Prime. NOW that would be AWESOME!

Those are pretty damn low numbers, would have thought they were much higher.

But it's good that at least one person in our justice system has common sense and threw this out.
