2 – The royalty base has to be related to the component that implements the technology in question not the end product.

3 – You should only demand a fair royalty fee. The royalty fee shouldn’t be any higher than what the market estimates dictate.

Motorola and Samsung couldnt care less about any of these three. Apple’s own FRAND patents adhere to those 3 basic FRAND commitment so does Microsoft, CISCO and many other companies. This has very little to do with Apple’s bogus patent portfolio on hardware design, it is a legitimate concern to the industry. You can take Apple completely out of the equation and you still have Microsoft under FRAND fire from Motorola also claiming 2.25% per XBOX sold. This is not a reaction to litigation is a reaction to sales. 

You cant just argue ‘Apple sued them’ to justify FRAND abuse, simply cause it really makes no sense.

Motorola and Samsung proposed such a ridiculous amount on royalty fees because they knew there was no way in this world Apple would accept them for the reasons posted on my first paragraph. So based on a refusal of this proposal they plan to seek an injunction. 

Keep saying go MOTO and go SAMMY, next thing you know you will end up paying thousands for a smartphone and many other electronic devices such as game consoles due to FRAND abuse.

patent law is a mess, a big mess.

patent law suits are als a good marketing tool.
gets you into headlines over and over again and you can say bad things about your competitor.
it is almost a weapon in social warfare.

Samsung, Motorola, Blackberry and such are not making tablets or smartphones based on their previous conception of a tablet and a smartphone. They are making iPhone like smartphones and iPad like tablets. Apple might not have the ‘right’ to say “no you cant use my product line as template for your new products” but there is no doubt that these companies didnt just magically come up with their design concepts without taking notes from Apple. 

‘Slide to unlock’ can be easily circumvented on so many ways like it has been. Now FRAND patents are a standard, something that all companies should have the right to license under reasonable terms. Apple did so and implemented this standard 3G tech while paying the fees they had to. All of a sudden the companies that own part of the standard exclude Apple so they can get more money of each iPhone sold? Pathetic. Truth is Apple is swiping the smartphone revenue and these companies together still cant make what Apple makes with only 9% market share. They want in, they want more, they are greedy, this is not about competition anymore, this is about making money out of thin air.

This is not an answer to Apple suing Motorola, this is an answer to Apple being succesful. Just like Motorola is also demanding 2.25% of each XBOX sold and Microsoft is going like WTF. Even if Apple wouldnt have sue anyone over iOS patents this was coming regardless.

Same thing if you call your phone company to request a phone line or Internet service.  In either case, if you’re using it for residential purposes, you pay one rate, and if you tell them it’s for business, the price goes up *for the exact same service*.  Because they know there’s more money to be had.
