Microsoft isnt doing anything wrong. Google just can’t take it that there competitor is making money of them over what they own wp7 rocks

I wonder, since android is free and open sourced, if the issue could theoretically skirted by selling the phone with a bootloader only and then providing a link and instructions to download the vanilla os google puts out. That way, nobody is technically selling the os and nobody can be sued.

But that statement does not say or imply any patent infringement. It might give Google developers plenty of different implementation ideas and may still not legally infringe. There needs a proper test case to determine this. ie, like the Apple feature which Samsung was found to have infringed and decided to strike off it in their updated release.

The big problem is to determine the value of the invention itself!. The Smartphone OS has in excess of 2000 patentable things in it, so how would one price a single patent ?. Or a dozen patents to that effect ?.
Again in Googleś case, they cannot indemnify a manufacturer because they are not charging money for the OS. Unless a manufacturer comes back to Google and said, I would rather pay you $14 per handset than to pay this money to MS, then it would be a different story. Google is not publicly objecting to MS licensing deals because they are not a direct party to the commercial agreement.

ahhh, again… I still vividly remember people like yourself predicting doom for xBox. How did that play out again? Ah, yes, I remember. Although I agree to some extent: The moment people get used to tiles as a successor of icons in Windows 8 they might understand the beauty of them and accept them on their cellphone as well – unless they listen to someone like you, of course…
