The first battle Apple had with Samsung in the Danish courts ended up with Apple losing 9 of 10 (90%) of their so called patent claims with regard to &quot; look and feel&quot; things like &quot; rounded corners &quot;among others. The one patent left standing was a frivourless thing that was fixed with an OTA update. Yes HTC had great sucsses defending themselves against Apple but Samsung before that was even more so. Yes the patents that Apple failed to uphold are now useless and by default they certanly can be considered invalid.I and everyone eles know about the more recent claims from Apple and the fact the the battles continue on other fronts such as &#039;core features&#039; but that has nothing to do with the patents i refered to in my post and as you said,those more recent ones have yet to be resolved. The only places your seeing injuntions is in Germany and Australia where their court system is set up for injuntion first court case later. If the party suing is willing to pay the costs should they lose then they get the injuntion, the party beind sued is not even informed of the injuntion until after it&#039;s been granted. In other words you can get one of these things easy but at least Australia had Apple list the ways the competition should build their tablets so they don&#039;t step on Apple&#039;s silly look and feel &#039;IP&#039; and what Apple demands is nothing short of comical : it can not have rounded corners, a flat surface, can not be the shape of a rectangle, no black bezel or no bezel at all, the screen can not appear dark when turned off, it should have raised edges and should look cluttered in it&#039;s appearence.This is just the look and feel stuff and is just the tip of the iceburg when it comes to the kind of restrictions Apple wants placed on the competition. It doesn&#039;t take a genius to see that Apple is trying to get a monopoly by insuring that the competition would not be able to make a product that could realistically compete. I believe there lawyers know that it&#039;s a monopoly that they never had a chance at getting in the first place but their marketing department could see the value in the headlines they could generate with these phoney lawsuits. Bad mouthing the competition in the press and control of the consumers mindshare is the real goal they have here and the best part is that they can go ahead and lose the vast majority of their claims and stiil they will have accomplished their conjob. You just can&#039;t buy advertisments like that and for Apple this sham has been worth every penny spent.
I do not &#039;hate&#039; Apple, it&#039;s their tactics that i despise. I think they make a great product and to be fair i think some of their newer claims do have merrit just like other companies have had legitimate beefs with Apple stepping on their IP. While i do think Samsung has done enough to differentiate they certanly could have done more, expescially with the touchwiz UI and some icon designs.]]></description>

		<description><![CDATA[I believe you are exaggerating and dishing out a lot false information. Please list the 90% of patents that have been invalidated. For example, the ITC  ruled that HTC did violate one patent, but didn&#039;t infringe on several others. The ITC did not invalidate any of these patents. A Danish judge ruled that the slide to unlock patent was likely invalid, but the case is on going. On the other hand, Samsung had to remove the copied bounce scroll feature to avoid an injunction. What else do you have? Most cases now are about getting injunctions, and there has been no final determinations on patent validity. 		<description><![CDATA[If i understand him correctly and i&#039;m sure i do what he&#039;s getting at is simple. Apple has brazenly exploited a broken patent system in order to obtain patents they must have known would be absolutely useless once challenged in court and sure enough 90% of these touchy feely type patents have indeed been invalidated by judges world wide. While the patent system is suppposed to be there to protect legitimate IP Apple instead used this system for a giant marketing campain disguised as lawsuits. Shamelessly using the press these lawsuits attracted to unfairly smear the competition and as a result, control the mindset of the consumer.Trying to use these patents in court not only displayed this companys incredible arrogance it also shows the high level of Apples disrespect for the true intent of the patent system and their total disregard for the court systems ment to uphold it. When all the dust settles i sincerely hope that all the manufacturers affected by these unethical tatics get together and bitchslap this company with a lawsuit in regards to their anti-competitive ways and in the process put a stop to this kind of posturing for good !!]]></description>

Go ahead challenge me! I hope to learn by discussion and be enlightened when my thinking is wrong.  It just doesn&#039;t make sense to me for Apple to have patents, but then be chastised for defending them.

		<description><![CDATA[Are you unaware that MS is forcing Android OEMs into licenses because Google&#039;s OS infringes on Microsoft&#039;s IP?  Microsoft has chosen to license their IP, that is their prerogative. Apple&#039;s preference is not to license their IP because they want their phone/iOS to be unique. Both approaches are fair. Instead of complaining, the other OEMs/Google can pay MS and use non-infringing features for their products. They can still make good smartphones without cheating. Unfortunately, too many people buy Google&#039;s evil spin.]]></description>
