Let’s find out who the employers are that are doing this and make it public knowledge. They’ll all go running for their PR departments trying to stem the damage. It is like the employers that were not hiring unemployed people. I questioned my insurance agent about that one once their company was on a list of employers playing that game. The damage control they had to do because of one rogue agent was hilarious. Ninety eight percent of Americans think this practice is despicable and would be willing to punish those employers.

Does this mean that if I don’t get a job, or get accepted to the college of my choice, that I can sue based on discrimination against me because of anything they find on my FB page? Good, I love easy money. One of these days we’ll all bump into a little tiny man rummaging around inside our brain looking for something. Who are the greasy little weasels that think up this stuff? No wonder I have such a hard time finding a job, Instead of using Facebook I use instant messaging & run my owns site that has all my information. Facebook is just a fad that will one day dissapear. Ehem MYSPACE was an empire, look at it now. MICROSOFT was an empire, now look at it…. Apple is on the rise now, but in 10 years? who will know. Everything great must fall so I dont even bother.

If you insist on have a Facebook account, then create two; one with your real name, which you will update once a week or so with totally innocent and useless data. The other one will be with your nickname, used only among friends, and NOT shared with anyone you don’t actually know.

I am an employer in California and would NEVER utilize my authority to violate someone’s privacy in such a manner. I don’t even have a FB account. What will be next? Demanding a key to your home to see how you live? Access to your checking account/credit card account to see what you buy or pay your bills? If your potential employer requires this of you, imagine what else they will be wanting once you are hired.

Somebody needs to get Facebook in on this, as these employers are forcing people to violate the Facebook TOS…and Facebook has a lot of money and can lobby to get what is a privacy and security risk for their users AND a security risk for them stopped.

The illegal part is that Facebook contains information about me that is illegal for potential employers to ask about, such as religion, age, marital status, number of children, etc…. If a company ever asks me for my Facebook info and then doesn’t hire me, I’d just sue them for illegal hiring practices, since they effectively asked me about the above information, which is illegal.

I completely disagree. Perhaps it’s not personal if you post it publicly, with no filter – like an unlocked twitter account. But many people have been using facebook since it’s inception in 2004, and now take advantage of the privacy settings so that only certain information is shared with certain people, kind of like having private conversations in face-to-face interactions….if anyone can recall what that’s like. If the service still allows you to select whom you want to friend, then you have every right to share information with your privately selected group in teh confidence that information is not directly available to anyone who want’s it. this isn’t a privacy issue, it’s a control issue.

While true, that’s a naive way of looking at it. That’s like saying, that there shouldn’t be any regulations on cigarettes because the answer is refreshingly low tech, if you want to live….don’t smoke. Hell to really not create a trail that employers could track, we should just stay off the internet, and do all transactions in cash and live in the woods.

The truth of the matter is that ones success in life is becoming more and more dependent on the network of people that have around them. The better you are at building and maintaining your network, the more opportunities you will have to be successful. (BTW: by better, I don’t necessarily mean bigger)

But students and job hunters should have the right to protect their information and their networks from potential employers. So I do think some regulation needs to be in place, on the flip side people need to not be stupid on these services. Regardless of whether there is a regulation in place this information gets out one way or another.

There’s nothing to say that an employer can’t fire you after then hire you, and you happen to friend them on FB. Many people have been fired for doing stupid things on their facebook pages.

I highly suspect over the next 3-5 years laws will be passed in every state that prevent this practice as Facebook pages to do include details that a potential employer is not permitted to ask.

Though I guarantee you that potential employers that do a bunch of background checks, have all this information before they hire anyway. They look at credit scores, and criminal records and any other public record they can get their hands on, and I bet this info is all listed in these places.

I’ll remove the hype so you can get a clear picture: the college admission dept looks at your test scores and grades from high school. The employer HR dept looks at your resume and cover letter. Bored half asleep people might someday look at your facebook, if you’re lucky.

This is horse huey. No employer has ever asked if I even knew what Facebook was or is. None have asked me to set one up, or remove one. Not one person has asked if I even had an account. No one has searched and said they thought they found me on there. Two family members have said they had a page, and it was like they were showing me a wheel barrel and talking about how it could move dirt. It was nothing more than talk you might hear if people were noticing the ad on a pizza box. SnoozeBook might be more fitting.

Chuck, glad I’m not looking for a job at your company. The first poster is correct. During the interview process, as but two examples, potential employers may not ask about marital status or children. Demanding access to FB would provide exactly this type of info. Once hired, the situation changes, but there are clear legal rules for during the hiring process.

How can it be considered ‘fair game?’ Hiring laws strictly limit interview questions to job related items only. Using this logic, a potential employer could ask you to open up your personal email. Don’t see how this practice is ethical or legal

It is NOT fair game to ask for your Facebook password. The Facebook TOS prohibits you from sharing your password with anyone AND if you have a FB account it is a violation to even ASK another user for their password. I would point this out to any employer/school and possibly report them.
