Best Buy would never hold back a sale unless there was a VENDOR agreement or had an ad the next day that said they would have a certain amount in stock. If the ad says they guaranty a certain amount in stock, they have to hold that many for that day.

I pre-ordered one and was 5th on the list but they told me they’re out. Even the case of the Xoom is not available (they have them available on their website at the same location though).
