I don't like people limiting my data. This is the same thinking by the small minded that are trying to control the size of my car, or my house, or telling me what to eat, and how much to eat. You make a smart phone that has all but replaced the computer on your desk, utilizing it for everything that you do, then it would stand to reason that you will move through a significant amount of data, and as phones progress, more and more data will be used. So if you can't handle it American Telephone and Telegraph then make way for Sprint or companies of the like that aren't playing little, "gotcha games", when you accidently go over your limit.

A limit of 4 movies and 5 hours of music... when high data usage was not available or popular AT&T reaped the benefits. So now that it actually benefits the loyal customers who overpaid in the first place its not longer convenient for them. I'm not even close to being in the 5% but this is just WRONG based on ethics/principle... How can they legally not give users what they paid for? The United States is a joke there is no accountability.

My experience is that Sprint's 3G network is either awesome or totally overloaded based on where you are. In NYC, I regularly get 1+ GB downstream -- in San Francisco during the day, a mere 190 KBps.

Their 4G network is another story. Consistently fast if you have 4G signal.

This is a joke and no lie that at&t false advertises. I bought an Atrix 4G phone a few months ago and it was pretty fast. I was getting around 4Mbps to 5Mbps speeds. Now I get under 1Mbps on the 4G H+ speed. I do have an old unlimited plan and although I use it almost daily I do not download or watch nearly enough content to justify paying $30 a month for this and not getting what they advertise. I called at&t about this and they try to make excuses saying that it must be my sim card or I need to try a factory reset. I know these things are not what will solve their slow network and I think if they continue this I will go with someone else and not bother their joke of a network.

As a regular user of TuneIn, I can attest to the fact that an hour of that app uses only about 20 MB of data. If you use it that long every day of the month, you're barely at half a gigbyte.

If I pay for 3G data rates and unlimited usage, is AT&T liable if they intentionally throttle the data rate back? I'm close to the 5% monthly usage amount on an un-jailbroken 3GS. I don't intentially abuse the unlimited rate, I just stream a lot of media in areas without wifi. My cable ISP also said I am in the top 5% for usage for steaming media. Data usage rates are only going to go up for all ISP users as Internet service evolve. I've intentionally kept my unlimted service for this reason. So is it a fair and/or lawful business practice for any ISP to intentionally not provide the service promised, in this case the data rates promised?

If you're using that much data, you may or may not be limiting anyone else's speed. If you are using your phone to check your email during peak usage hours in a congested area of the network, you might be limiting other people's speed. If you're using your phone to stream videos in the wee hours of the morning, you're probably not limiting other people's speed. The network has the same capacity no matter what time of day, but the amount of traffic on it varies. Why not put a speed limit up during peak hours? Why limit anyone when practically everyone else is asleep, or not using their phones? Quite frankly, if Spotify can give me unlimited streaming for 10 bucks, why can ATT only give me 5 hours for 30 bucks? How is that fair?
