		<description><![CDATA[its ok, im finally ok with all this.. i dont care who wins (really like sammy tho :) because they (/ppl) are ruining their already fragile rep. i went from im ok with /ppl to absolutly hating them, and im a drop in a VERY big bucket that filling fast! oh btw this case was just settled in the UK where the judge demanded that /ppl make public apologies for their stupidity; seems to be a repeat happening globally. i simply do not understand how they (/) can sue over and over for the same thing. simply because it took place in another country? soon we will hear of people getting mugged or beat up because they have idevices.

You don&#039;t like it then don&#039;t buy it. BTW ALL OF the companies want you to buy a new product every year or 2. This includes the Wireless providers too. Yes google did steal. To say that the CEO of google leaves the board of apple then comes up with the new software is tantamount to saying he left with the idea. If you don&#039;t see this then I got a bridge to sell you. My only sticking point is that NO APPLE SHOULD NOT get gobs of money. YES the infringing products should be banned. I think that is fair. The frand issues should be decided in favor of Samsung, but NOT THE gobs of money they want. Take the price that they have been charging others and call it a day!]]></description>

		<description><![CDATA[Facing a jury is not Samsungs problem here, they have had great success having Apples so called IP invalidated by the court in other parts of the world. The biggest challenge for Samsung is this particular judge. This is a women who says that the g-tab and ipad are &quot;virtually indistinguishable&quot; while having held them in hand !! She reminds me of most of the women i&#039;ve known, they can&#039;t tell cars apart either other than to say &#039;the cute red one&#039;,lol. Now we have learned that she won&#039;t allow pictures of Apples &#039;Sony inspired&#039; mockups to be shown in court. This on top of the creator of said Sony designs refusing to testify. If there ever was a judge familiar with tech needed for a case it would be this one. So far this judge seems more concerned about not appearing to favour her parents Korean heritage and being a good American than she is about doing whats right.]]></description>

She reminds me of most of the women i&#8217;ve known, they can&#8217;t tell cars apart either other than to say &#8216;the cute red one&#8217;,lol. Now we have learned that she won&#8217;t allow pictures of Apples &#8216;Sony inspired&#8217; mockups to be shown in court. This on top of the creator of said Sony designs refusing to testify. If there ever was a judge familiar with tech needed for a case it would be this one. So far this judge seems more concerned about not appearing to favour her parents Korean heritage and being a good American than she is about doing whats right.</p>

Not once has any of these articles described the essence of the dispute in clear terms. There is the typical and predictable regurgitation of what everyone else is saying or snipits from company mouths (both sides) but where is the independent analysis? Any fool can say &quot;if this then that&quot; but how about breaking down the question of the challenges to IP so that for once, the covers are pulled away and we all see things for what they really are?


Online articles such as this have become the standard, each mimicking only what someone else has already written, change a few words, jumble the paragraphs and publish. It almost makes you want Apple to patent writing just so that what passes for reporting and analysis today gets smacked down.


Try this: The essence is look and feel. The argument then is do customers feel the same about Samsung tablets and phones as do the customers buying Apple&#039;s products? Highly doubtful. Apple itself admits to selling the &quot;experience&quot; so following that, is the experience of owning and using a Samsung phone or tablet the same as the experience consumers get from Apple products? Again, highly doubtful.


The issue is about a rectangle. Obviously, a rectangle can be the basis for many difference things and that is where Samsung went so wrong it almost deserves to lose. While you can&#039;t really do that much with a rectangle other than perhaps change the dimensions and round the corners, Samsung missed the opportunity of a lifetime. Anyone guess?


For crying out loud, Samsung makes displays no? Are all the displays basically rectangular? Absolutely. Samsung with all it&#039;s technological resources can&#039;t figure out how to make a display that has rounded corners so that the display itself projects from the rounded corners too? Apple hasn&#039;t done that. All Samsung had to do was put a display on it&#039;s products that had as part of the displayed area, rounded corners instead of square or rectangular and end of story. It can&#039;t be done? Of course it can. Samsung has numerous opportunities here, instead of displaying imagery from the OS, make the rounded display corners present notification information about battery state, WiFi connectivity and anything like that, just make the corners rounded and seamless in appearance to the user.


Suddenly, the rectangular shape of the display melds with the rounded rectangle of the case design, something Apple does not have.


Now, if Apple has any ideas on this, they had better hire better lawyers since I hereby donate this design  to the public domain without any strings attached.  Samsung, are you listening? ]]></description>
