Apple sued for deceptive Siri advertising

A class action lawsuit has been filed against Apple, claiming that the company used "misleading and deceptive" advertising for its Siri voice-activated intelligent assistant feature on the iPhone 4S. The lawsuit was filed by New York resident Frank M. Fazio in the US District Court of Northern California.

Fazio claims that Siri is not as capable as Apple has demonstrated in its commercials and that the feature's real-world performance is generally spotty and even at times completely unusable. He gave an example of when he asked Siri for directions but the app either could not understand what was asked or took a very long time to respond, and even then, gave the wrong answer.

Since Siri is exclusive to the iPhone 4S, Fazio believes that it led consumers to spend more money on the new iPhone instead of getting the cheaper iPhone 4, only to find that Siri didn't work as promised. The lawsuit claims that Apple is in breach of warranty and has violated the Consumers Legal Remedies Act as well as California's Unfair Competition Law.

Fazio's lawyers called Siri "at best, a work-in-progress." This is something that Apple hasn't denied as Siri's been considered a beta product since launch last October. In Apple's latest commercials it has also featured disclaimers that the Siri demos were shortened for advertising purposes.
