IMO, unless the software is directly related to the hardware, i.e. kernels and kernel-based behaviors, they shouldn’t be patented.
And even then, I think that’s a bit of a grey area

Just as when companies developing laptop accessories, etc, use pictures of Dell notebooks in their applications, it doesn’t mean Apple are trying to claim anything about FutureTap’s IP.
