No, because it has never been about monopoly! The real issue is majority market share! Itunes do not have to have 100% of the market as long as it has the highest percentage of the bunch. And the real question is how Apple use that market share to leverage its way into other markets like mobile phones, tablets or similar.

As such one can see a pattern: First there was ipod getting a good market share in portable music. Then Apple tied it to itunes and the music store service. Then they added more services and more features to the ipods. Then came the iphone that tied directly into the market share of the itunes services. And then ipad doing the same.

That's a really mature response! Vulgarity is the substitute for thought and civil discussion. By the way, your caps lock key is stuck.

You are right, though! The Galaxy tablet looks so much like a carbon copy of the iPad that I kept imagining it had a home button. Still, justices and commissions around the world are deciding that Samsung did, indeed, rip off Apple.

I place a lot more confidence in their considered judgment than juvenile responses!

Sounds like Microsoft to me! Check out the Patent Office filings for Apple and you may sing a different tune. Of course, as an Apple-bashed, you'll blast the entire patent system.

Perhaps you can enlighten us as to who created an integrated touch system with the set of gestures iOS uses (multi-touch, pinch-zoom, etc.) for a smartphone *before* Apple?

It'd be nice to avoid the ad hominens!

One of Apple's "patents" is a "rectangle with rounded corners." Give me a freaking break. Have you ever looked at a cuneiform tablet from ancient Babylon? A rectangular "communication device," with rounded corners. The iPad looks like a small, modern flat screen TV. Or one of the electronic pictures frames built by (you guessed it) Samsung before the iPad was twinkle in Apple's eye. And there have several tablets (as a matter of fact almost all tablets before iPad) that were rectangular with rounded corners. This is the most ridiculously insane and asinine miscarriage of justice (so-called) that I've ever seen. Apple can't compete on an even playing field, after all they're not the one inventing the components, so they have to try to sue to keep up their huge net profit margin and their Logo cultists.

So you have no idea what you are talking about. Touch technology was not invented by Apple. Even multi-touch technology was not invented by apple. Apple has almost never done anything original infact. They just copy other peoples work, but make it much, much better. That is why they succeed. But to suggest that Apple should be granted patents for taking someone elses work, and then improving on it is insane!

The Galaxy looks like a *carbon copy* of the iPad, coloring, etc., even down to the home button. Pretty obvious rip-off and judges and commissions around the world are agreeing with Apple.

Apple deserves to hold patents on the touch technology and gestures-- pinch-zoom, liquid scroll, etc. All these other companies should have to be pay licensing fees, especially when they slavishly copy Apple's brilliant work.

feeding a probable troll here but...

While monopoly may be a poor choice of word by the judge, Apple do have a incumbent position via the itunes music store and their other bundled services. As such, they need to thread carefully or get slapped in the same way Microsoft was when they thought they could bundle a web browser with Windows to compete with Netscape (MS had already pulled a similar trick by bundling a exchange client with a earlier windows version, so that they could talk admins into replacing Novell Netware with Exchange).

Using a majority position in one market (online entertainment content sales) to leverage ones way into a different market (tablets) i a legal minefield.

I don't care what the patent is. There should not be a single patent on earth deemed valid if said patent prevents realistic competition and as a result allows for a monopoly. Apple dosen't mind if others make a tablet they just don't want to see it do well, hence many of their rather generic patents. One of my favourites is the patent for scrolling on a touch screen. Apple has one that describes the ability to scroll even if the gesture is not a perfectly straight line, the page will continue to move anyway. In other words the competition has to make a tablet that abruptly stops it's scroll should the user deviate a few degrees from a perfectly straight line when they swipe with there finger. Absolutely insane!! Many of Apples so called patents should have been tossed into the frand bundle a long time ago and any deemed valid but still essential for competitions sake should be subject to fair and reasonable licensing fees that still allow competitors to build a profitable device.

Yeah.......given that the interfaces of the two devices are completely different, Apple is really innovative. They don't want anyone to make anything resembling a square screen. Their patent makes one wonder if they'll go after digital picture frame manufacturers, TV manufacturers, etc.

The design of the iPad is "obvious" in such a way that it should not be patent-able IMO. All tablets are is a picture fram basically. You have manufacturers trying to get a glass panel into as small an area as possible which leads to the obvious decision to have edge to edge glass. And you need to hold it without gouging yourself which leads to the obvious decision to round the corners. It needs to be durable which leads to the obvious decision to use metal as a casing.
